Welcome to www.helpotherz.com (“HelpOtherz”). HelpOtherz is owned and operated by CK Ramchand Foundations (“Ramchand Foundation”, “We”, “Us”, or “Our”), a charitable trust registered under the laws of India.
HelpOtherz enables and facilitates: (i) Donors to make monetary contributions through the Platform to support Campaigns where Beneficiaries seek donations-in-kind; (ii) Trusts to raise donations from Donors; (iii) marketing and outreach of Campaigns; (iv) procurement and delivery of Materials to Beneficiaries; and (v) enabling Trusts to identify and onboard Beneficiaries.
By accessing, browsing, or using HelpOtherz, You (“You” or “Your”) agree to comply with and be bound by these Terms of Use and Our Privacy Policy. If You do not agree, please do not use the Platform. These Terms shall be enforceable as a legally binding agreement between You and Ramchand Foundation.
HelpOtherz replaces monetary donations with transparent product donations. Donors fund the purchase of Materials for Beneficiaries via the Trusts. All payments are processed through verified gateways and directed to registered Trusts. If any Material is unavailable, equivalent-value items may be procured for the same Campaign. Ramchand Foundation verifies Campaigns at its discretion but does not guarantee their accuracy. Donors should exercise independent judgment before contributing. HelpOtherz simplifies charitable giving. By participating, Donors consent to share limited details with relevant Trusts or Beneficiaries for acknowledgment. Donors may choose anonymity. Once Materials are supplied, electronic confirmations may be sent. Foreign Donors must comply with the Foreign Contribution (Regulation) Act, 2010 (FCRA). Contributions from non-Indian citizens are routed only through FCRA-registered Trusts. Donations for political or prohibited purposes are strictly forbidden. Beneficiaries must ensure Campaigns are accurate, lawful, and non-misleading. Ramchand Foundation may remove Campaigns that violate these Terms or applicable laws. Beneficiaries must share updates on utilization of donated Materials with Trusts and Donors when requested. HelpOtherz or the Trusts may suspend or terminate Campaigns for non-compliance or misuse of donations. Donations are processed via secure payment gateways and are non-refundable. Any applicable bank or gateway fees are payable by the Donor. Materials are delivered upon Campaign completion or earlier if required. Once Materials are donated, no further obligations remain between Donor and Beneficiary. Trusts engaged on HelpOtherz are responsible for procuring and donating Materials according to Donor selections. They must ensure compliance with applicable laws, including FCRA and Section 80G of the Income-tax Act, 1961. HelpOtherz may deduct agreed service charges from donations. Tax exemption receipts, if applicable, are issued solely by the Trusts. Beneficiaries must provide accurate registration documents (trust deeds, PAN, 12A/80G certificates). False or misleading information may result in delisting or legal action. HelpOtherz does not charge Beneficiaries to host Campaigns and does not guarantee the genuineness of their claims. Donors must perform their own due diligence. All information and media (“Content”) on HelpOtherz are for general information only. Ramchand Foundation makes no warranties regarding accuracy or completeness. You must not copy or reuse Platform content without written consent. You are solely responsible for any material or information You submit (“User Content”). You grant Ramchand Foundation a limited, royalty-free license to use, display, and distribute such content for providing Services and promoting Campaigns. User Content must not infringe any third-party rights or contain unlawful material. HelpOtherz may link to external websites or display third-party advertisements for convenience. Ramchand Foundation is not responsible for their content or privacy practices. Interactions with such parties are solely at Your discretion. The Platform is intended for users aged 18 and above. By registering, You agree to provide accurate details, maintain account security, and accept responsibility for activities under Your account. Ramchand Foundation may modify or terminate accounts for misuse or non-compliance. You shall not use HelpOtherz for illegal, infringing, defamatory, obscene, or harmful purposes. Prohibited acts include spamming, hacking, virus transmission, and misuse of data. Ramchand Foundation reserves the right to remove violative content and report offences to authorities. HelpOtherz and its Services are provided on an “as is” and “as available” basis. Ramchand Foundation makes no warranties—express or implied—regarding availability, accuracy, or suitability. We shall not be liable for any direct or indirect losses arising from use of the Platform, service interruptions, or third-party failures. You agree to indemnify and hold harmless CK Ramchand Foundations from all claims, losses, or damages arising out of Your use of HelpOtherz, breach of these Terms, or violation of law or third-party rights. Your use of the Platform is governed by our Privacy Policy. You must protect all non-public information obtained through the Platform and may disclose it only when required by law or authorized by Ramchand Foundation. HelpOtherz and its content are the property of CK Ramchand Foundations. All trademarks, logos, and materials are protected by intellectual-property laws. You may not copy, modify, or distribute them without written consent. These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts at Hyderabad, Telangana. Unresolved disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. Proceedings shall be in English at Hyderabad. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. Failure to enforce any right shall not constitute a waiver of that right or any other rights under these Terms. All official communications shall be sent via email to info@helpotherz.com or to the registered email address provided by You in Your account. Ramchand Foundation shall not be liable for delays or non-performance due to events beyond its control, including natural disasters, acts of government, or technical failures. These Terms constitute the entire agreement between You and CK Ramchand Foundations regarding the use of HelpOtherz and supersede prior understandings. Nothing herein creates any partnership, agency, or joint-venture relationship. CK Ramchand Foundations may assign its rights and obligations to affiliated trusts or successors without prior notice.
